Riverfront Federal Credit Union Member Privacy Policy

The Board of Directors, Management and employees of Riverfront Federal Credit Union (RFCU) are concerned about and respect the privacy of our members' personal financial information. We are committed to providing you with top quality products and excellent service. We understand that our members furnish sensitive information to the credit union in the course of day to day business, and we are committed to treating such information responsibly. We know that our members expect privacy and security for their personal and financial affairs. We want to assure you that we pride ourselves on meeting and exceeding your expectations.

Our members can be assured that RFCU will take all necessary steps to safeguard sensitive information that has been entrusted to us. The following privacy policy and disclosure outlines our practices regarding personally identifiable financial information for members and others with whom we establish a "member relationship" pursuant to 12 CFR §716 of the National Credit Union Administration's Rules and Regulations.

Types of Information Riverfront Collects

At RFCU, we collect nonpublic personal information (NPI) from various sources. The credit union collects NPI directly from members, joint owners, co-borrowers and guarantors on various applications and forms (e.g. loan applications, deposit account applications, and requests for information about accounts or products and services).

RFCU also collects information as a result of transactions between the credit union and such individuals, and as a result of providing our products and services. This includes transaction information from share drafts (checks), debit cards, credit cards, automated teller machine (ATM) cards and electronic transfers (consistent with home "banking" or automated clearinghouse (ACH) transactions). RFCU also collects information we receive from a consumer-reporting agency, such as a credit bureau.

NPI does not include information the credit union obtains from government records, widely distributed media or government-mandated disclosures.

Types of Information RFCU Discloses

RFCU may disclose the following types of NPI about current or former members:

  • Identification information we may receive from you on applications or other forms such as name, address, social security number, assets, income and telephone number;
  • Transactional information such as account balance, payment history, parties to transactions and credit card usage; and /or
  • Information we receive from a consumer-reporting agency such as your credit worthiness and credit history.

RFCU may disclose NPI about current or former members to the following types of third parties:

  • Financial service providers, such as mortgage bankers, insurance agents and securities broker/dealers;
  • Non-financial companies, such as retailers, direct marketers, airlines and publishers; and/or
  • Other entities, such as nonprofit organizations.

RFCU may disclose the following information to companies that perform marketing services on our behalf or to other financial institutions with which we have joint marketing agreements:

  • Identification information we may receive from you on applications or other forms such as name, address, social security number, assets, income and telephone number;
  • Transactional information such as account balance, payment history, parties to transactions and credit card usage; and/or
  • Information we receive from a consumer-reporting agency such as your credit worthiness and credit history.

Safeguarding Member Information

At RFCU, we protect a member's privacy by restricting access to NPI to only those employees who have a business reason for knowing such information. We maintain physical, electronic and procedural safeguards that comply with federal regulations to guard your NPI. The credit union has appointed a committee responsible for maintaining internal procedures to ensure that our members' information is protected.

All credit union employees have a copy of this Policy as well as the credit union's internal privacy policy and are trained regarding the importance of safeguarding members' information. Disciplinary action will be taken against any employee who violates the credit union's privacy policy and/or procedures.

If we change our policy or practice by, for example, adding a category of information that will be disclosed to a third party, the credit union will notify existing members and give them an appropriate time period to opt out of the disclosure.

Member's Right to Opt Out of Sharing Agreements

We may disclose NPI about you to non-affiliated third parties as permitted by law. If you prefer that we not disclose NPI about you to non-affiliated companies, you may opt out of those disclosures; that is, you may direct us not to make those disclosures (other than permitted by law).

If a member chooses to opt out at the time of establishing an account with RFCU, we will honor the request immediately. A member may choose to opt out of the information sharing agreements at any time. If a member notifies the credit union after an account is opened or an application processed, the credit union will cease sharing the member's information within 30 days from the date the member's request is received.

Exceptions to a Member's Opt-Out Rights

By law the credit union is permitted to disclose certain personally identifiable information in the following instances:

  • To companies that perform transaction processing for the credit union…
    • If the transaction, service, or product is requested or authorized by the member.
    • To maintain or service a member's account as part of a private label credit card or other loan extension program.
    • In connection with a securitization, secondary market sale (including servicing rights) or similar transaction related to a member.
  • To disclose information necessary to enforce the credit union's legal or contractual rights or the rights of any other person who is engaged in the financial transaction.
  • To disclose information required in the ordinary course of business, such as in the settlement of claims or benefits, the confirmation of information to the member or their agent, and the billing, processing and clearing of items in the normal course of business.
  • To provide information to: insurance rate advisory organizations, guaranty funds or agencies, agencies that are rating the credit union, persons that are assessing the credit union's compliance with industry standards, and/or the credit union's attorneys, accountants, and auditors.
  • To the extent permissible under the Right to Financial Privacy Act.
  • To a consumer reporting agency under the Fair Credit Reporting Act.
  • To comply with federal, state, or local laws, rules, and other applicable legal requirements.

RFCU may also disclose personally identifiable information to non-affiliated third parties with whom we engage to market our own services or products to members. The credit union will not provide members' personal information to non-credit union companies for the purpose of their independent telemarketing or direct mail marketing of any non-financial products or services.

If the credit union shares information with a third party or a non-affiliated marketing firm for the purpose of informing our members about our new products or services, the credit union will enter into a written agreement with the third party that will require the party to maintain the confidentiality of the information in the same manner that the credit union would restrict its own use.
